Terms and Conditions of Villa Luciano

Contract
When contracting us to rent Villa Luciano, no contract will exist between us until we have received the required deposit and we have issued the official confirmation invoice.

Brochure and web site Information
Great care has been taken to ensure the accuracy of the information contained in our brochure and web site relating to any service advertised. However, all statements as to the condition of the property or other services included in the brochure and the web site must not be treated as statements of fact but statements of opinion.

Payment
If the booking is made more than 56 days prior to departure, deposits are payable as follows: 30% of the Villa rental cost. The balance of the cost will be shown on the confirmation invoice and must be paid 56 days prior to departure. If payment is not made by the due date we reserve the right to cancel the holiday lets and to apply cancellation charges.

Credit cards
We are not liable for any foreign transaction fees that credit card companies may apply to your account.

Late bookings
Bookings within 56 days of departure are deemed late bookings. Full payment is required immediately and once received by us, all booking conditions apply.

The Cost
The price payable is the price relating to the holiday lets of Villa Luciano as published from time to time and detailed in the information sent to you by us (price list and general information). Where the cost of the holiday lets falls under two seasonal prices, the rate applicable shall be charged. The total cost of the holiday lets will only be subject to surcharges in the event of any Government action. Should any increases imposed exceed 10% of the holiday cost, you may cancel and receive a full refund provided the cancellation is made within 14 days of being notified of any such increase.

Cancellation by you
You may cancel the holiday lets, notifying us in writing, at any time prior to departure. The following charges apply which are payable by you depending on the date we are properly notified of the cancellation: a)up to 56 days before departure specified on the confirmation invoice, the requisite deposit; b) between 55 and 14 days of departure a charge of 70% of the holiday cost; c) Less than 14 days prior to departure, the cancellation charge is 100%.

Cancellation by us
We may occasionally have to cancel your holiday lets as a result of force majeure, (see 18) that is any occurrence outside our control and which could not have been avoided with all due care.

Modification by you
If you wish to modify your booking once it has been confirmed, we may accept the alterations. Changes to your holiday dates for the villa rentals will be treated as cancellation and re-booking and the applicable cancellation charges as set out above will apply. In all other aspects modifications can be made by you and are subject to a charge of £80 per modification. A significant change is a change of dates altered by more than 24 hours.

Modification by us
If a significant change (see 18) occurs to any part of your rental period we will advise you as soon as possible providing we know of any change prior to your departure. You will be given the choice of accepting revised arrangements or cancelling and accepting a full refund of all monies paid to us.

Our Liability to you
We have taken all due care in making the arrangements applicable to your holiday but we cannot accept liability in respect of any injury, loss or damage however caused to you unless by our direct negligence.

Transferability
If you or a member of your group is unable to travel you may transfer that place to another person provided we have 14 days notice and that the substitute member satisfies these booking conditions. All costs incurred in making the changes must be paid when the transfer is made.

Breakage deposit
A security deposit is payable by you on arrival at Villa Luciano. This may be paid in cash, Travell or Eurocheque or by credit cards. The amount of this deposit will be shown on the information sent to you by us.

Care of Property
You are responsible for ensuring that the villa provided are left upon departure in the same condition of cleanliness and repair as upon arrival. Any loss or damage caused by your failure to respect the property fixtures or fittings will be deductible by the breakages deposit.

Party Size
Property Owner reserve the right to refuse admittance if the number of persons arriving exceeds the number on the booking form or the maximum sleeping places as detailed in the relevant brochure description.

Animals
We regret that our guest cannot bring animals to Villa Luciano

Complaints
We hope that you are not dissatisfied with any aspect of your holiday lets. In the event that you are dissatisfied you must report the cause to the keyholder of the villa, to allow us the opportunity to rectify the problem. In the unlikely event that you are still not satisfied upon your return from holiday lets, you must write to us giving full details within 14 days. If you fail to notify us of any dissatisfaction during your holiday we cannot accept liability for that complaint in retrospect.

Law and Jurisdiction
Your contract with us is governed by Italian Law and to the exclusive jurisdiction of the Italian Court.

Force Majeure and Significant Change
These include events which are caused as a result of acts of God, Governments, hostilities of war, political unrest, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, theft, epidemics quarantine, medical or customs regulations, technical or administrative problems with transport, closure of airports, breakdowns with machinery and equipment, adverse weather conditions, water shortages or any other occurrences outside our direct control and could not have been avoided even with all due care.

Holiday Lets Insurance Cover
It is a stipulation of the booking that you must arrange a suitable insurance cover. This should be to cover you against loss of irrevocable deposit and charges following necessary cancellation of your holiday rental from death, injury or illness occurring after your booking or been made redundant all occurring before arrival at Villa Luciano for your holiday lets. Details of your policy cover must be sent to us within 7 days from our booking confirmation invoice. Failure to do so may result in the cancellation of your holiday lets and charges may apply.
